Bijection Commercial Licence Agreement

This Agreement governs your use of biject migrate (“the Software”), the commercial component of Bijection, licensed by Cody Byers (“we”, “us”).

The rest of Bijection — the biject library, the schema, data and batch commands, and the desktop application — is free software under GPL-3.0-only and is not governed by this Agreement. See LICENSING.md.

By installing or using the Software you accept these terms. If you do not accept them, do not use the Software; if you have already paid, request a refund under section 8.

1. What you may do

We grant you a non-exclusive, non-transferable licence to use the Software:

Output belongs to you. The SQL the Software generates is yours, with no claim, royalty, or attribution obligation from us — run it, commit it, publish it, sell products built with it.

2. What you may not do

We cannot technically prevent most of this. The licence check is a courtesy to honest buyers, not a security measure, and we have deliberately not built anti-circumvention machinery, telemetry, or any phone-home. This section records what is permitted; we rely on you to honour it.

3. Seats, and what counts as one

A seat is one human being who runs the Software, or who directs automation that runs it on their behalf. Continuous integration does not consume seats: if four developers share a licence and a CI pipeline runs the Software a thousand times a day, that is four seats, not one thousand and four.

Seats are named, not concurrent. Two people alternating on one seat is two seats.

4. What you get, and for how long

Your licence names a version ceiling and is perpetual for it. A licence issued against 0.4 entitles you to run every 0.4.x release, including patch releases published later, for as long as you like. We cannot revoke it, and it will not expire.

It does not unlock later minor or major versions. Moving to 0.5 requires a new licence at whatever it then costs.

There is no subscription, no renewal, and nothing to cancel.

5. Support

Support is best-effort by email at [email protected]. We aim to reply within a few working days. No response time is guaranteed and none is being sold to you.

Bug reports for the free components belong in the public issue tracker, where everyone benefits.

6. What the Software does not do

The Software writes SQL files. It never connects to a database to execute them. It reads schemas in order to compare them, and it produces a script for a human to review and run.

You are responsible for reviewing generated SQL before running it against any system you care about, and for having a backup you have tested restoring. Some generated statements destroy data; those are marked, and are withheld entirely unless you pass --allow-destructive.

Do not run generated DDL against production without reading it first. The Software cannot know your constraints, your data volume, your replication topology, or your maintenance window.

7. No warranty, and limits on liability

THE SOFTWARE IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY UNDER THIS AGREEMENT IS LIMITED TO THE AMOUNT YOU PAID FOR THE LICENCE. WE ARE NOT LIABLE FOR LOST PROFITS, LOST OR CORRUPTED DATA, BUSINESS INTERRUPTION, OR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY.

Some jurisdictions do not allow these exclusions. Where that is so, the above applies to the greatest extent permitted, and nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Nothing in this Agreement affects statutory consumer rights you have that cannot be waived by contract.

8. Refunds

If the Software does not do what you expected, ask for a refund and you will get one. Email [email protected] within 30 days of purchase. You do not need to justify the request, and you may keep any SQL already generated.

Purchases are processed by a third-party merchant of record, who is the seller of record for the transaction and handles payment and applicable taxes. Refunds are issued through them, so the money returns by the route it arrived.

This policy is in addition to any statutory right of withdrawal you have.

9. Termination

This Agreement ends if you materially breach it — most plainly, by redistributing the Software or sharing licence keys beyond your seats — and we notify you in writing. On termination you must stop using the Software and delete your copies.

We will not terminate for non-payment, because there is nothing recurring to not pay.

Sections 7, 10 and 11 survive termination.

10. Governing law

This Agreement is governed by the laws of the State of Arizona, United States of America, excluding its conflict-of-law provisions, and excluding the United Nations Convention on Contracts for the International Sale of Goods.

11. General

This Agreement is the entire agreement between us regarding the Software and supersedes any prior understanding. If a provision is found unenforceable, it is replaced by the closest enforceable provision and the rest stands. A failure to enforce a term on one occasion does not waive it.

We may revise this Agreement for future licences. Changes never apply retroactively: the version you received with your licence governs your licence, permanently.
